CM APPL. 18646/2025(Exemption)

The Delhi High Court dismissed an appeal filed by Garima Jain (appellant/mother) against an order passed by the Family Court granting visitation rights to Rohit Jain (respondent/father) for their minor child. The Court observed that:

1. The child needs love and affection from both parents for psychological, social, and mental development.

2. The custodial parent (mother) should facilitate a congenial atmosphere for the child to interact with the father.

3. The father’s visitation rights are essential for developing a bond with the child and contributing to their well-being.

The Court:

1. Upheld the Family Court’s order granting unsupervised visitation rights to the father.

2. Directed the mother to cooperate and facilitate the child’s interaction with the father.

3. Left the issue of maintenance and transportation allowance to be decided by the Family Court in a pending execution petition.

The appeal was dismissed, finding no merit.
